1. Introduction
These Terms of Service (“Terms”) govern access to and use of The Study Floor website, mobile applications, software, educational tools, AI-powered services and related services (collectively, the “Services”).
The Study Floor is a trading name and service operated by Townhouse Education Ltd, a company registered in England and Wales (Company No. 15698178) with its registered office at 3rd Floor, 86–90 Paul Street, London, England, EC2A 4NE (“The Study Floor”, “we”, “our”, or “us”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.
2. Eligibility
- You must be at least 13 years old to use the Services.
- If you are under 18 years old, you confirm that you have the permission of a parent or legal guardian.
- If you use the Services on behalf of a school, tutoring business, company or other organisation, you confirm that you have authority to bind that organisation to these Terms.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account unless such activity results from our negligence or security failure.
- You must notify us immediately if you suspect unauthorised access to your account.
4. Description of Services
The Study Floor provides educational technology services, including but not limited to:
- AI-powered study tools;
- revision resources;
- educational content;
- tutoring support tools;
- learning analytics;
- progress tracking;
- messaging and collaboration features; and
- related educational software services.
We may modify, improve, suspend or discontinue any aspect of the Services at any time.
5. Acceptable Use
You agree not to:
- use the Services for any unlawful purpose;
- upload unlawful, abusive, threatening, defamatory, obscene or harmful content;
- infringe any intellectual property rights;
- attempt to gain unauthorised access to any systems;
- scrape, harvest or extract data from the Services;
- reverse engineer, decompile or otherwise attempt to discover source code;
- interfere with security features;
- upload viruses or malicious code;
- use automated systems to access the Services without our written consent;
- use the Services for plagiarism, cheating, impersonation, academic misconduct or examination fraud.
We reserve the right to suspend or terminate accounts that violate these Terms.
6. AI Generated Content
The Services may utilise artificial intelligence and machine learning technologies. AI-generated content may contain inaccuracies, omissions, outdated information, bias or errors.
You acknowledge and agree that:
- AI-generated content is provided for educational and informational purposes only;
- AI-generated responses should be independently verified;
- academic decisions should not rely solely upon AI-generated content;
- we do not guarantee accuracy, completeness or suitability of AI-generated content.
The Study Floor is not responsible for examination outcomes, academic performance, university admissions decisions or similar outcomes arising from reliance upon AI-generated content.
7. User Content
You retain ownership of content uploaded, submitted or created by you through the Services (“User Content”).
You grant The Study Floor a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and display User Content solely for:
- providing the Services;
- maintaining platform security;
- improving platform functionality;
- complying with legal obligations.
You represent that you have all necessary rights to upload User Content.
8. Subscriptions and Payments
- Certain Services may require payment.
- Subscription fees are charged monthly or annually as selected during registration.
- All fees are payable in pounds sterling (GBP).
- Subscription fees are non-refundable except where required by law.
- We may change pricing by providing at least ninety (90) days’ notice.
- If you do not accept revised pricing, you may cancel your subscription before the changes take effect.
9. Free Trials
- We may offer free trials from time to time.
- At the end of a free trial period, access may be restricted until a paid subscription is activated.
- We reserve the right to modify or withdraw trial offers at any time.
10. Cancellation
- You may cancel your subscription at any time through your account settings.
- Cancellation will take effect at the end of the current billing period unless otherwise stated.
- No refunds will be provided for unused portions of subscription periods except where required by law.
11. Termination
We may suspend or terminate your account if:
- you breach these Terms;
- you fail to pay applicable fees;
- your activities create security risks;
- your activities harm other users;
- we are required by law.
Upon termination, your right to access the Services immediately ceases.
12. Service Availability
The Services are provided on an “as available” basis. We do not guarantee uninterrupted availability.
Service interruptions may occur due to:
- maintenance;
- upgrades;
- third-party failures;
- cyber security incidents;
- circumstances beyond our reasonable control.
13. Intellectual Property
All intellectual property rights in the Services, software, branding, content, designs and functionality remain the property of The Study Floor, Townhouse Education Ltd or our licensors. No ownership rights are transferred to users.
14. Disclaimer
The Services are educational tools only. We do not guarantee:
- examination success;
- academic improvement;
- university admissions;
- employment outcomes;
- educational achievements.
15. Limitation of Liability
Nothing in these Terms excludes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any liability which cannot lawfully be excluded.
Subject to the above, our total aggregate liability shall not exceed the total fees paid by you during the twelve months preceding the event giving rise to the claim.
We shall not be liable for:
- indirect losses;
- consequential losses;
- loss of profits;
- loss of revenue;
- loss of goodwill;
- loss of data;
- educational outcomes.
16. Data Protection
We process personal data in accordance with our Privacy Policy. Where applicable, users remain responsible for obtaining all necessary permissions and lawful bases for personal data uploaded to the Services.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or through the Services. Continued use of the Services constitutes acceptance of updated Terms.
18. Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction in relation to disputes arising from these Terms.
